Anti-terrorist legislation
Every person, regardless of the reason that have led to them being detained
or imprisoned, have fundamental and inviolable rights. These are contained
within the International Agreement on Civil and Political Rights,
the Convention against Torture and other Cruel, inhuman or degrading treatment,
and other instruments contained within the framework of the United Nations,
as well as the European Convention for the Protection of the Rights
and Fundamental Freedom of the Person and the European Convention for
the Prevention of Torture and other Cruel, inhuman or degrading treatment
that were adopted within a European framework.
The Spanish State has ratified all of these International agreements and
declarations, and therefore, according to the Spanish Constitution of
1978, at the time of interpreting internal legislation on the subject
they must take these agreements into account.
Throughout this project we are going to try to analyse the situations
that arise involving Basque citizens that are detained by Spanish State
Security Forces, and in which "Anti-terrorist" legislation is used. The
legal frameworks, both national and international, will be examined.
We will centre ourselves on the whole process that begins when the person
is detained in the Basque Country for political reasons, and is thus accused
of belonging to, or collaboration with, an armed organisation. We will
also study the actions of the Judicial power and other actors that participate
in the process.
